1. Prayer in this petition, filed under Section 482 of the BNSS,
2023 (earlier Section 438 Cr.P.C.), is for grant of anticipatory bail to the
petitioner, who has been booked in a criminal case arising out of First
Information Report, as detailed hereunder:-

2. On 17.10.2025, following order was passed:-
"2. Learned counsel for the petitioner inter alia, contends, that except for the offence under Section 458 IPC (Section 331(6) of BNS), all other offences involved are bailable in nature. Petitioner is related as brother-in-law (devar) of the complainant, and the matter essentially pertains to a family dispute.
3. Further submits that co-accused persons, namely Bobby Singh and others, have already been

granted interim anticipatory bail by this Court, vide order dated 29.07.2025 in CRM-M-40208-2025 (Annexure P-3). Similarly, Gurpreet Singh alias Gopi and others have also been granted interim anticipatory bail by this Court, vide order dated 22.08.2025 in CRM-M-45846-2025 (P-4). Both these petitions are scheduled for hearing on 30.10.2025. Furthermore, petitioner has expressed readiness to join the investigation and cooperate fully, provided protection from arrest is granted by this Court. Thus, counsel prays for grant of anticipatory bail to the petitioner in the present case.

5. On advance notice, Mr. Neeraj Madaan, Sr. DAG, Punjab, puts in appearance on behalf of the respondent - State, and seeks some time to file status report in the matter.
6. Adjourned to 30.10.2025.

7. Meanwhile, the petitioner is directed to join the investigation as and when required to do so by the Investigating Agency. In the event of his arrest, the petitioner shall be released on ad-interim bail, subject to his furnishing bail bonds to the satisfaction of the Arresting Officer. The petitioner shall also be abide by all the conditions laid down under Section 482(2) of BNSS, 2023 (earlier Section 438(2) Cr.P.C.).
8. Besides, it is directed that petitioner would hand over his passport to the Investigating Agency or to Court concerned, if he possesses. Otherwise, would submit an affidavit, disclosing the fact that he does not possess any passport.
It is also directed that before leaving country any time during trial, petitioner would seek prior permission of the Court."
3. After hearing the submissions addressed by counsel for the
petitioner(s), on 30.10.2025, following order was passed in the present
petition, and other connected petitions, i.e. CRM-M-40208-2025, CRM-
M-45846-2025, CRM-M-46969-2025, CRM-M-46990-2025, CRM-M-
57567-2025 and CRM-M-45905-2025:-
"i) In compliance with the directions dated 21.08.2025 passed in CRM-M-45905-2025, the

following persons are present in Court: Paramjit Kaur (petitioner), her husband Vikas Singh (petitioner in
CRM-M-46990- 2025), and Smt. Harjinder Kaur (complainant in the cross case, which has been filed against Paramjit Kaur, Vikas Singh, and others). Other petitions have been filed by friends and relatives of the parties detailed above.
ii) After some deliberations in open Court, it has been revealed that the actual dispute is between two brothers, i.e., petitioner Vikas Singh (in CRM-M-
46990-2025) and petitioner Karan Singh (in CRM-M- 58971- 2025), who is siding with his mother Harjinder Kaur, while Vikas Singh is married and with his wife Paramjit Kaur. Presently, they are ready to resolve their family dispute before the Mediation and Conciliation Centre of this Court.
iii) Let all the concerned parties, i.e., accused and complainant/victim in the FIR case as well as in cross case, be present before the Mediation and Conciliation Centre of this Court on 12.11.2025.
iv) Let an experienced mediator, having sufficient expertise, be appointed for resolving the family dispute.
v) For awaiting report, adjourned to 29.01.2026.
vi) Interim order to continue.
vii) A photocopy of this order be placed on the files of other connected cases."
4. Incident in question has resulted in both version and a cross-
version being recorded by the respective affected parties. FIR No. 31
dated 13.05.2025 was registered under Sections 331(6), 118, 115(2),
324(4), 191(3), and 190 of the Bharatiya Nyaya Sanhita (BNS), on the
basis of the statement made by Paramjeet Kaur. In response thereto, a
cross-version was also registered at the instance of the accused party in
the present case, vide DDR No.48 dated 13.05.2025.
5. As per the report received from the Mediation and
Conciliation Centre of this Court, petitioner(s) (in all the present case as
well as connected cases, mentioned here above) have amicably settled
their dispute with the complainant, through a compromise agreement.

6. Vide settlement agreement dated 12.11.2025, all the parties
have agreed to withdraw all the proceedings arising out of the FIR as
well as cross-version case.
7. Terms and conditions of the compromise, as recorded in
paragraph No.4(a) to 4(e) of the report submitted by the Mediation and
Conciliation Centre of this Court, are reproduced below:-
"Terms & Conditions
(a) The parties have agreed and accepted that the terms of the present settlement shall be applicable to the parties signing the present settlement as well as their friend and well wishers involved in the case who have filed separate petitions as noticed and directed by the Hon'ble High Court in the referral order dated 30.10.2025.
(b) The parties have agreed and accepted that both brothers shall jointly measure the dimension towards West side that is 102 Feet as half each i.e. 51 feet each and shall put a common point 'C' as shown on site-
plan (Annexure-A) and after measuring the East side
1..e 86 Feet also as half-half i.e. 43 feet each and at Point 'D' on the site-plan shall put a common pillar share of Vikas Singh is marked as CBGD and share of Karna Singh is marked as CAFD as shown on site- plan signed by all persons present.
(c) The parties have further agreed and accepted that Karan Singh shall construct a wall from road i.e. from point 'C' to the point 'E' parallel to the construction of Karan Singh as shown on site-plan in his own share i.e. the wall shall be within 51 feet. The parties have drawn a site plan and signed the same and is attached herewith as Annexure-A and shall form the part of present settlement.
(d) The parties have further agreed and accepted that the measurement and putting pillars shall be done within 15 days from today.
(e) All the parties have agreed and accepted to file quashing petition of the FIR i.e. No.31 dated

13.05.2025 under Section 331(6), 118, 115(2), 324(4), 191(3), 190 of BNS registered at Police Station Amir Khas, District Fazilka Punjab and cross case i.e. General Diary/Rapat Roznamcha No.48 dated 13.05.2025 under Section 331(6) 324(4), 115(2), 191(3), 190 of BNS registered at Police Station Amir Khas, District Fazilka Punjab on the basis of present settlement. All persons shall be bound to make statement or submit affidavit as the case may be or as directed by the Hon'ble High Court."
8. On the other hand, learned State counsel while vehemently
opposes for grant of anticipatory bail to the petitioner, submits that some
of the accused who have already granted the concession of interim relief
by this Court, have neither fully cooperated the investigating agency nor
joined the investigation, when called upon to do so. Thus, he prays for
dismissal of the present petition.
9. This Court has heard the submissions addressed by counsel
for the parties and has also gone through the record available before it.
10. In view of the settlement arrived at between the parties, this
Court deems it appropriate to dispose of the present petition, by directing
the petitioner to join the investigation within two weeks from today, or as
and when called by the investigating agency, and in the eventuality of the
arrest, petitioner would be released on anticipatory bail, subject to his
furnishing bail bonds to the satisfaction of the Arresting Officer. The
petitioner shall also be abide by all the conditions laid down under
Section 482(2) of BNSS, 2023 (earlier Section 438(2) Cr.P.C.).
11. Besides, it is directed that petitioner would hand over his
passport to the Investigating Agency or to Court concerned, if he possess.
Otherwise, would submit an affidavit, disclosing the fact that he does not
possess any passport.

It is also directed that before leaving country any time during

12. With the directions recorded here above, present petition
stands disposed of.
