1. The prayer in the present petitions under Section 483 BNSS,

2023 is for the grant of regular bail in case bearing FIR No.116 dated

26.07.2025 registered under Sections 21(b), 27(a), 61, 85 of NDPS and

offence under Section 29 of NDPS Act, 1985 added later on at Police Station

Sultanwind, District Police Commissionerate, Amritsar.

2. As per the prosecution case, Jaswinder Singh @ Sunny was

apprehended with 5.31 grams of heroin along with Rs.600 of drug money. On

CRM-M-63782-2025 & another connected case -2-

his disclosure statement, Sandeep Singh @ Gyani was nominated as an

accused. He was apprehended and the recovery of 9.04 grams of heroin along

with Rs.500 of drug money was effected from him.

3. The learned counsels for the petitioners contend that

non-commercial quantity of contraband has been recovered from the

petitioners. As the petitioner-Jaswinder Singh @ Sunny has undergone 07

months and 07 days and petitioner-Sandeep Singh @ Gyani has undergone

06 months and 23 days of custody having been granted the concession of

interim bail by this Court vide order dated 16.02.2026, they are entitled to the

concession of regular bail.

4. On the other hand, the learned State counsel admits that the

recovery effected from the petitioners is of non-commercial quantity of

contraband, that they have been granted the concession of interim bail by this

Court vide order dated 16.02.2026 and that the petitioner-Jaswinder Singh @

Sunny has undergone 07 months and 07 days and petitioner-Sandeep Singh

@ Gyani has undergone 06 months and 23 days of custody.

5. I have heard the learned counsel for the parties.

6. Admittedly, taking the prosecution case to be correct, non-

commercial quantity of contraband has been recovered from the petitioners.

Petitioner-Jaswinder Singh @ Sunny is handicapped to the extent of 100% as

he is suffers from locomotor disability. They were both granted the

concession of interim bail by this Court vide order dated 16.02.2026. As

such, petitioner-Jaswinder Singh @ Sunny has undergone actual

imprisonment of 07 months and 07 days and petitioner-Sandeep Singh @

Gyani has undergone actual imprisonment of 06 months and 23 days.

Therefore, in this situation, the further incarceration of the petitioners is not

required.

7. Thus without commenting on the merits of the case, the present

petitions are allowed and the petitioners are ordered to be released on bail on

their furnishing fresh bail bonds and surety bonds to the satisfaction of

learned CJM/Duty Magistrate, concerned.

8. The petitioners (or anyone on their behalf) shall prepare an FDR

in the sum of Rs.50,000/- each and deposit the same with the Trial Court. The

same would be liable to be forfeited as per law in case of the absence of the

petitioners from trial without sufficient cause.

9. The petitions stand disposed of.

10. A photocopy of this order be placed on the file of the connected

case.
