i) Present application has been filed under Section 482 Cr.P.C.,

seeking preponement of the date of hearing of the main case, i.e., CRM-

M-67233-2025.

ii) As the main case is listed today itself, the present application

has, therefore, rendered infructuous.

CRM-7048-2026

i) Present application has been filed under Section 482 Cr.P.C.,

for placing on record the bail orders of co-accused Abhay Kumar and

Akash Kumar @ Kansi @ Ashok dated 29.08.2024 and 23.05.2025

respectively, whereby bail was granted to the said co-accused by the co-

ordinate Bench of this Court, as Annexure P-8 and P-9.

ii) For the reasons stated in the application, same is allowed,

and orders dated 29.08.2024 and 23.05.2025 are hereby taken on record

as Annexures P-8 and P-9. Registry is directed to tag the same at the

appropriate place in the paper-book.

1. Present petition has been filed under Section 483 of BNSS,

seeking regular bail in case FIR No.35 dated 29.03.2024, under Sections

307, 323, 324, 34 IPC (Sections 326 IPC and 201 IPC were added later

on vide GD No.23 of 02.05.2024 and DDR No.30 dated 12.03.2025

respectively), registered at Police Station Sujanpur, Tehsil and District

Pathankot

2. The FIR in the present case was registered on the basis of

the statement made by Prince Sidhu and the same has been reproduced

below:-

" Statement of Prince Sidhu S/o Ved Masih Sidhu R/o Shekhan Mohalla Sujanpur District Pathankot aged around 33 years Mobile No. 95010-66616 stated that I am residing above mentioned address and working on the contract basis at Punjab Mandi Board. On dated 25.03.2024, I was present at my home then my friend namely Kumar Gaurav S/o Kishan Chand R/o came at my home Shekhan Mohalla Sujanpur District Pathankot. Then my friend Kumar Gaurav came and told that Akash@ Kashi and his brother Abhay S/o Rakesh Kumar R/o Prem Nagar Sujanpur Hall Chak Phull Pyara Sujanpur had taken quarrel with him at near Shani Mandir Bridge No. 4 Sujanpur due to his motorcycle has struck with his scooty of above said persons. Then I and along with my friend Kumar Gaurav went to the house of Akash @ Kashi and above said persons for talking about the

incident then around 09:30 PM when we reached at his house then Akash @ Kashi met us at outside of his house then Akash @ Kashi picked one brick from the street and attacked two times on Kumar Gaurav which was hit on his head and Gaurav was injured when I take back the Kumar Gaurav and reached at Madhopur beas link river bridge of bhanwalpur then Abhay armed with datar along with Kannu s/o Sabi r/o prem nagar Sujanpur armed with datar came from Sujanpur side and Akash @ Kashi came from the back armed with Kirch Akash @ Kashi gave four blows of kirch on me with the intention to kill me which was hit on my chest, abdomen, back of the neck and right arm then Abhay attacked on me with datar with the intention to kill me which was hit on my head then I put forward my right arm for defending myself which was hit on my right arm, Resultantly I fell down. Then Abhay Kumar attacked on my back with his datar and then Kannu attacked on my right side of head with the back side of the datar with the intention to kill me and all of them were attacked on Kumar Gaurav with the intention to kill him. Resultantly, he got some injuries on his head and his body. We got more injuries and they thought that they killed us and ran away from the spot with their respective weapons. Then I arrange the phone of some passerby and call my brother Thomas Sidhu. Then Rahul Sidhu s/o Peter r/o Sekhan Mohalla Sujanpur reached on the spot. Then he arranged the vehicle and brought at the CHC hospital Sujanpur for the treatment where they refer us to the civil Hospital Sujanpur due to serious conditions of the victims where doctor gave us the treatment and issue the MLRs and refer to the Amritsar then my

family has admitted me at Amandeep Hospital Pathankot where I am admitted and Family of the Kumar Gaurav has admitted him at the hospital which has taken the treatment at Kapoor hospital Amritsar. Above said accused has tried with the intention to kill us. I have submitted my MLR before you. Statement is correct and best of my knowledge. Legal action must be taken against the accused. Sd/ Prince Sidhu"

3. Learned counsel for the petitioner submits that the

complainant/injured, namely Kumar Gaurav and Prince Sidhu, have

suffered a total of nine injuries. Kumar Gaurav sustained two injuries on

his head at the hands of co-accused-Akash @ Kashi @ Ashok Kumar, of

which one was grievous. Prince Sidhu suffered seven injuries, of which

two were caused by co-accused Akash @ Kashi @ Ashok Kumar

(including one grievous injury on the chest and others on the stomach and

back of the neck with a kirch), and two injuries were caused by co-

accused Abhay Kumar (one on the right arm and one on the back with a

dattar). Injury attributed to the petitioner-Jatin is limited to one simple

injury on the right side of the head of Prince Sidhu with a dattar. Learned

counsel further submits that both co-accused Abhay Kumar and Akash

@ Kashi @ Ashok Kumar have already been granted bail by the co-

ordinate Bench of this Court vide orders dated 29.08.2024(P-8) and

23.05.2025(P-9), passed in CRM-M-33823 of 2024 and CRM-M-23460-

2025 respectively.

Counsel submits that petitioner is in custody since

19.11.2025 and is not found involved in any other case. Counsel submits

that trial is likely to take considerable time as no prosecution witness has

been examined till date, thus, prays for grant of bail.

4. Learned State counsel opposes the grant of bail to the

petitioner and submits that the allegations against him are serious in

nature, as he is stated to have caused injury to complainant-Prince Sidhu

with a sharp-edged weapon. Learned State counsel further submits that

the offence involves multiple co-accused and a clear motive as alleged in

the FIR, which cannot be ignored. Therefore, prays for dismissal of

present petition.

5. I have heard Learned Counsel for the parties and perused the

paper book and the documents appended thereto.

6. Considering the fact that petitioner is 24 years of age and is

in custody since 19.11.2025, is not involved in any other criminal case,

the injury attributed to him is of simple nature, no prosecution witness

has been examined till date, and the trial is likely to take considerable

time, this Court is of the view that further incarceration of the petitioner

would not serve any useful purpose.

Without commenting on the merits of the case, present

petition is allowed . Petitioner is ordered to be released on bail, subject to

his furnishing bail/surety bonds to the satisfaction of the learned trial

Court/ Chief Judicial Magistrate/Illaqa Magistrate/ Duty Magistrate

concerned, if not required in any other case.

7. Any of the discussion done and recorded hereabove, shall

not be construed as an expression of opinion on the facts of the case.

Therefore, trial Court is expected to decide the case by taking an

independent view, on the basis of evidence available on record, as

expeditiously as possible in accordance with law.
