Noticing the prayer made in the application, main case is taken on

Board.

CM-9197-C-2024 in/and RSA-1200-2014

1. Instant second appeal has been filed assailing judgment and decree

dated 28.05.2013, passed by learned Additional District Judge, Jhajjar, whereby

the appeal of the appellant was partly allowed by setting aside judgment and

decree dated 06.09.2011, passed by learned Additional Civil Judge (Senior

Division), Jhajjar.

2. Mr. Ravinder Singh Budhwar, Advocate, has put in appearance on

behalf of the respondents, and has filed Power of Attorney, which is taken on

record.

3. On the basis of the prayer made in the application (CM-9197-C-

2024), counsel for the appellant submits that the entire payment pursuant to the

impugned judgment and decree of the learned First Appellate Court has been

paid, except for the interest on the delayed payment. It is his assertion that the

interest component has not been paid as the present appeal is pending. He

seeks and is granted permission to withdraw the appeal.

4. Appeal is dismissed as withdrawn.

5. However, in case, the interest is not paid, liberty is granted to the

appellant to seek revival of the appeal.

6. Pending application is disposed of.
