There is a delay of 397 days in filing the present revision

petition, which is directed against judgment dated 15.3.2022 passed by

learned Additional Sessions Judge, Faridkot vide which an appeal filed by

the petitioner assailing his conviction for offence under Sections 25 of Arms

Act as recorded by learned Judicial Magistrate 1 st Class, Faridkot vide

judgment and order of sentence dated 3.2.2018, has been dismissed.

The reason assigned for condoning the delay is that the

petitioner is a poor person and has been behind bars and could not make any

arrangement for requisite funds and he took some time to arrange for the

record and ultimately the present revision petition came to be filed through

Free Legal Aid.

This Court finds that learned District & Sessions Judge &

Secretary, District Legal Services Authority visit the jail premises every

month and it is highly unlikely that the petitioner would not have come to

know about availing of Free Legal Aid for about one year. In any case, the

petitioner has already undergone the sentence as had been imposed upon

him. Finding no merit in the instant application, the same is dismissed.

Consequently, the instant revision petition i.e. CRR-1202-2023

also stands dismissed being time barred.
