1. Learned counsel would submit that the petitioner has not been

granted ACP despite being eligible for the same, having passed the

departmental test. However, similarly situated employees have been granted

the said relief in terms of the judgments Mohinder Singh and another vs.

State of Haryana and another, CWP-15840-2015, decided on 21.04.2016,

Arvind Kumar vs. State of Haryana and another, CWP-27226-2015,

decided on 08.11.2016, State of Haryana and another vs. Mohinder Singh

and another, LPA-174-2017, decided on 06.04.2017, Naveen Kumar and

others vs. State of Haryana and another, CWP-12018-2019, decided on

28.01.2020, (Annexures P-4 to P-7). In this regard, a legal notice dated

17.04.2024 (Annexure P-9) has been served upon the respondents, which has

yet not evoked any response. He thus, at this stage, on instructions, prays that

a direction be given to the respondents to decide the same in a time bound

manner.

3. At the asking of the Court, Ms. Vibha Tewari, AAG, Haryana

accepts notice on behalf of the respondent-State and has no objection to the

limited prayer made.

4. In view of the above and without commenting on the merits of

the case, this petition is hereby disposed of with a direction to the respondents

to decide the legal notice dated 17.04.2024, taking note of the aforesaid

judgments, in accordance with law, expeditiously.
