The appellant has filed the instant appeal against the

judgment and decree dated 31.08.1994, passed by the learned trial Court

whereby the suit for declaration filed by the plaintiffs/respondents has

been allowed and the judgment and decree dated 24.10.1997, passed by

the learned Appellate Court, whereby the appeal preferred by the

appellant against the aforesaid judgment and decree dated 31.08.1994,

has been dismissed.

Learned counsel for the appellant, on instructions from Mr.

Ajay Dua, Assistant in the office of Municipal Corporation, Faridabad,

submits that the plaintiffs/respondents were further promoted and they

all have retired from service during the pendency of the present appeal.

The date of retirement of all the plaintiffs/respondents, is as under:-

A perusal of the file shows that although the appeal was

admitted, however, there was no stay with regard to implementation of

the judgments and decrees passed by the Courts below.

Learned counsel for the appellant submits that at present,

he shall not press the instant appeal, however, liberty may be granted

that in case any execution is filed by any of the plaintiff, the appeal may

be revived and decided on merits.

Disposed of with aforesaid liberty.
