1. The present civil writ petition has been filed under Articles 226/227 of
the Constitution of India for issuance of a writ in the nature of mandamus directing the respondents to consider and promote the petitioner as a Lecturer in Commerce against the quota meant for promotees from the due date.
2. Learned State counsel makes a reference to the preliminary objections of the written statement filed by respondent No.2, which reads thus:
"The turn of the petitioner to be promoted him as Lecturer did not come so far. As and when his turn will come for promotion as Lecturer in commerce, his case would be considered in accordance with the law. It is significant to note that no person junior to the petitioner has been promoted as Lecturer in commerce so far by the respondent."
3. In wake of the above, learned counsel for the petitioner submits that the
present petition has been rendered infructuous and may be disposed of as such,
however, liberty be granted to the petitioner to revive it, if need arises.
4. Ordered accordingly.
