1. Prayer in the present petition is for transfer of the petition

filed by the respondent-husband under Section 13 of the Hindu Marriage

Act, 1955 (for short 'the Act'), bearing case No.HMA-540-2023, titled as

Simranjit Singh vs. Paramjit Kaur, pending before the learned Additional

Principal Judge, Family Court, Chandigarh to a Court of competent

jurisdiction at Sirsa.

2. Upon notice, respondent has appeared in person and submits

that the present petition has been rendered infrurctuous as the parties have

settled all the inter se disputes and on a petition filed under Section 13-B

of the Act before Family Court, Sirsa, a decree of divorce by way of

mutual consent has been granted, vide judgment and decree dated

20.12.2023. The respondent has produced in Court a photocopy of the

petition under Section 13-B of the Act, the statements recorded at first

motion on 16.11.2023 and that at second motion on 20.12.2023, as well as

the certified copy of the judgment and decree dated 20.12.2023,

dissolving the marriage by way of a decree by mutual consent.

3. Learned counsel for the petitioner does not dispute the

aforesaid and thus, prays for withdrawal of the present petition.

4. Accordingly, dismissed as withdrawn.

5. It is, however, made clear that on account of the present

petition having been withdrawn, the interim order dated 18.09.2023 stands

vacated, which otherwise merges with the final order, as such.
