1. Present writ petition has been filed by the workman,

challenging the award dated 27.01.1997, passed by learned Industrial

Tribunal-cum-Labour Court - II, Faridabad, whereby reference No.164 of

1995 under Section 10 (1) (c) of the Industrial Disputes Act, has been

answered against him.

2. Though, learned Court gave its observation that as per some of

the entries, petitioner - workman is found to be working as a Clerk in the

office of Municipal Committee, Palwal, but the reference cannot be

answered merely on the basis of the said fact.

3. Moreover, in the letter written by the Secretary for Executive

Officer, Municipal Committee, Palwal (appended with the writ petition as

Annexure P-4), a fact has been recorded that petitioner - workman worked

from May, 1994 to October, 1994, but only a photocopy of the said letter has

been produced on record and has not been proved, in accordance with law.

4. Present writ petition pertains to the year 1997 and with the

efflux of time, it is highly doubtful that whether any cause still survives with

the petitioner. Moreover, nothing substantial in favour of the petitioner has

been brought on record to prove his employment with the Municipal

Committee, Palwal.

5. This Court does not find any substantial reason to interefere

with the findings recorded by learned Presiding Officer, Labour Court - II,

Faridabad, in award dated 27.01.1997.

6. In view of the aforementioned observations, present writ

petition stands dismissed.
