By way of present appeal, challenge has been laid to

judgments and decrees dated 27.04.2018 and 29.10.

29.10.2019 2019 passed by

the Courts below, whereby, a suit for declaration filed at the instance of

appellant-plaintiff plaintiff laying challenge to the e sale deed dated 17.03.

17.03.2020

allegedly executed by by her in favour of respondent No No.1 .1 came to be

dismissed.

2. Post notice of motion, the parties to the appeal being

represented by their respective counsels have been praying for time to

place on record a settlement settlement deed arrived at between them, however however,,

despite having availed more than 3 opportunities, the needful has not

been done. Even today, no one has chosen to appear on behalf of

respondent No.1.

3. Learned counsel for the appellant has produced a

photocopy otocopy of settlement deed dated 01.11.2023 which is signed by the

appellant as well as respondent No.1 and also submits that in

pursuance to aforementioned settlement,, sale deed dated 01.11.2023

bearing Vasika No.2023-24/186/1/9514 stands executed in favour of

appellant at the instance of respondent No.1 and thus, with the change

of ownership, qua the suit property, no cause survives in favour of the

appellant for the purpose of pursing the present appeal.

4. In such circumstances, the present appeal is disposed of

being rendered infructuous.
