1. Dr. Sukant Gupta, Advocate, has entered appearance on behalf

of the appellant and submits that the earlier counsel, who had filed the

instant appeal, has since unfortunately passed away. He has filed his Power

of Attorney in the Court today, which is taken on record.

2. At the outset, learned counsel for the appellant submits that as

per his written instructions, the appellant has accepted the impugned

judgment and decree and in compliance thereof, an amount of Rs.29,220/-

has been credited to the respondent-company. In view of the above, he has

been further instructed to withdraw the present appeal. He, thus, prays so.

3. Dismissed as withdrawn.
