1. The petitioner through instant petition under Articles

226/227 of the Constitution of India is seeking direction to respondent to

re-issue his passport.

2. The petitioner was issued passport on 12.09.2012 which

expired on 11.09.2022. The petitioner applied for re-issuance of passport

on 28.08.2022.

3. The respondent has not issued passport on the ground that an

FIR No.13 dated 23.02.2022, under Sections 324, 341, 148 and 149 of

IPC is pending against the petitioner.

4. Learned counsel for the petitioner submits that till date

challan has not been present against the petitioner. The case of the

petitioner is squarely covered by judgment of this Court in Mohan Lal @

5. Learned State counsel on instructions from ASI Rameshwar

Dass submits that it is factually correct that police has not presented

challan in the aforesaid FIR against the petitioner.

6. On being confronted with aforesaid facts and judgment of

this Court, learned counsel for respondents No.1 and 2 submits that

competent authority after considering aforesaid judgment would pass an

appropriate order within 6 weeks from today.

7. In the wake of statements of learned counsels for the

respondents, the present petition stands disposed of.
