The present writ petition has been filed, assailing the

order dated 11.02.2021 passed by the respondent No.4,

whereby the application (Annexure P-2) filed by the petitioner for

transferring the election petition from the Court of Sh. Rohit

Gupta, SDM Khadoor Sahib to any Court of competent

jurisdiction was dismissed.

As per the reply filed by way of affidavit of respondents

No.4 and 5, the matter was sub-judice before the court of SDM-

cum-Election Tribunal, Khadoor Sahib and was fixed for final

arguments. The arguments have already been heard and the

case is fixed for pronouncement of final judgment.

Learned State counsel on instructions from the office of

Deputy Commissioner, Tarn Taran submits that since the

Presiding Officer of the Election Tribunal, Khadoor Sahib has

already been transferred, therefore, nothing survives in this writ

petition.

In view of statement made by learned State counsel,

this writ petition is dismissed as having been rendered

infructuous, however liberty is granted to the petitioner that in

case statement of fact made by learned State counsel is

ultimately found to be otherwise, then an appropriate application

be filed for revival of the present petition.
