The petitioner is seeking regular bail in FIR No.15 dated 20.12.2019, under Sections 21, 25 and 29 of the Narcotic Drugs and Psychotropic Substances Act, 1985, registered at Police Station State Special Operation Cell, Amritsar, District Amritsar.

2. Learned counsel for the petitioner submits that 9 kg of heroin is alleged to have been recovered from the car owned by the petitioner. The petitioner is in custody for almost 04 years. He is not involved in any other case under the NDPS Act. Learned counsel has relied upon the judgment of the coordinate Bench of this Court in the case of Jagdip Singh @ Jagdeep Singh @ Soni Vs. State of Punjab, CRM-M-21155-2023, decided on 03.05.2023 wherein recovery of 8 kg heroin had been effected and the petitioner therein had been granted regular bail after he had undergone

custody for a period of about 2 years.

3. Custody certificate filed by the learned State counsel is taken on record which indicates that the petitioner is in custody for 3 years, 11 months and 4 days. She also submits that 10 out of 25 prosecution witnesses have been examined.

4. Heard.

5. In view of the above, especially when the petitioner is in custody for almost 4 years, he is not involved in any other case under the NDPS Act and conclusion of the trial is likely to take some time, I deem it a fit case to grant the concession of regular bail to the petitioner.

6. Therefore, without expressing any opinion on the merits of the case, the instant petition is allowed. The petitioner is ordered to be released on regular bail on his furnishing requisite bonds to the satisfaction of the trial
