1. The petitioner through instant petition under Article 226/227 of

the Constitution of India is seeking setting aside of letter dated 24.10.2019

(Annexure P-10) whereby petitioner has been held ineligible and letter dated

05.12.2019 (Annexure P-11) whereby respondent No.5 has been selected for

appointment of retail outlet dealership.

2. This Court vide order dated 05.09.2023, relying upon judgment

of a Coordinate Bench of this Court in Pushpinder Marya and Another v.

Bharat Petroleum Corporation Ltd. and Another, CWP No.28939 of 2019, has

dismissed CWP No.23603 of 202 (Manpreet Kaur v. State of Punjab and

Others). The ground of rejection of candidature in all those petitions was same

as in the present case.

3. In the case in hand, concededly the Appendix-III B Certificate

was of a date post date of application. It is apt to notice that petitioner had also

failed to submit NOC of all co-owners in Appendix III A.

4. Faced with this, learned counsel for the petitioner expressed his

inability to distinguish his case.

5. In the wake of order dated 05.09.2023 passed by this Court in

Manpreet Kaur (supra), the present petition deserves to be dismissed and

accordingly dismissed.
