1. The present regular second appeal has been filed against the

judgment dated 13.02.1990 passed by learned Additional District Judge, Ludhiana

whereby the appeal filed against the judgment and decree dated 14.10.1988 had

been dismissed.

2. None had been appearing on behalf of the appellant as and when the

case was taken up as such notice was issued to the appellant as well as his counsel.

3. As per office report, notice issued to the sole appellant has been

served and his learned counsel Mr. Ravinder Jain informed telephonically.

However, none appears despite the case having been called out twice.

4. It appears that the appellant is not interested in pursuing the present

case.

5. Dismissed for non-prosecution.

6. Registry is directed to send a copy of this order to the appellant at the

last known address, as also to the concerned SHO of the area to intimate the same.
