1. The present appeal has been filed by the appellants-defendants against judgment and decree dated 20.08.1990 passed by learned Lower Appellate Court and the judgment and decree dated 18.08.1987 passed by the trial Court, whereby both the Courts below had erroneously decided all the issues against the appellants-defendants.

2. As is apparent from the perusal of order dated 21.11.2013 passed in this case, Mr. Rajesh Chaudhary, Advocate who was engaged by the appellants had since passed away and in place of his, Mr. Bikram Chaudhary, Advocate had appeared but he pleaded no instructions. Thereafter, none has put in appearance on

behalf of the appellants despite notice having been issued to them.

3. It appears that the appellants are not interested in pursuing the present appeal.

4. Dismissed for non-prosecution.
