1. The petitioner through instant petition under Articles 226/227 of

the Constitution of India is seeking direction to respondent No.2 to re-issue

him passport.

2. The petitioner was issued passport which expired with the efflux

of time. The petitioner applied for re-issuance of passport. An FIR No. 195

dated 29.11.2013 under Sections 420, 466, 467, 468, 471 & 120-B of Indian

Penal Code, 1860 at Police Station Kamboj, Amritsar came to be registered

against the petitioner. The police after completing investigation filed

cancellation report, however, it was returned by the Trial Court. The police

has neither filed cancellation nor otherwise report before the Trial Court in the

aforesaid FIR.

3. Learned counsel for the petitioner submits case of the petitioner

is squarely covered by judgment of Mohan Lal @ Mohna Versus Union of

India and Others; 2023 SCC OnLine 1391.

4. Learned State counsel does not dispute the afore-stated factual

position with respect to aforementioned FIR.

5. Learned counsel for the respondent Nos.1 and 2 asserts that

passport authority would consider grievance of the petitioner and pass an

appropriate order within 6 weeks from today in the light of judgment of

Mohan Lal (supra).

6. In the wake of statements of learned counsels for the parties, the

present petition stands disposed of.
