The challenge in the petition is to the order dated 25.05.2023 (Annexure P-26), whereby while deciding the representation of the petitioner, he has been issued a show cause notice requiring him to submit the explanation as to why appropriate legal action be not taken against him. Pursuant thereto, the petitioner has filed a reply (Annexure P-27).

2. Learned State counsel, appearing on advance notice, submits that the competent authority is seized of the matter and has still not taken a final decision.

3. In view thereof, the petition cannot be entertained being premature, and is, accordingly, disposed of granting liberty to the petitioner to raise all the pleas as have been raised in this petition, before the competent authority enabling him/her to consider the same before passing the final order.

4. In case any adverse order is passed against the petitioner, the same

shall not come into effect for a period of ten days therefrom.
