Learned counsel for the appellant submits that the appellant is a

party aggrieved by the impugned order and judgment and despite being a

necessary party to the lis was not arrayed as such in the writ petition.

Accordingly, he prays for and is permitted to withdraw the appeal with

liberty to move an appropriate application before the learned Single Judge as

regards his grievances, in the first instance.

Dismissed as withdrawn with the aforesaid liberty.
