[1] Challenge in the instant appeal by the appellant/plaintiff is to

judgment and decree dated 24.12.2013 passed by the learned Additional

District Judge, Bhiwani in Civil Appeal No.314 of 2012 in case titled as

Ram Phal vs. Pawan and another whereby the appeal of the

appellant/plaintiff as well as civil suit was dismissed by reversing the

findings of the learned Civil Judge (Jr. Div.), Charkhi Dadri vide which

the suit of the appellant/plaintiff was decreed partially.

[2] At the outset, learned counsel for the appellant states that in

view of compromise between the parties, the appellant is not interested in

pursuing the instant appeal and may be permitted to withdraw the same.

[3] In view of the statement of learned counsel for the appellant,

the instant appeal is dismissed as withdrawn.
