This is an application for disposing the main appeal in view of the

terms and conditions of award of Lok Adalat dated 10.01.2018 (Annexure A-

1). Main case is taken on board today itself. Application stands disposed of.

Main appeal (O&M)

Learned counsels for the appellant submit that parties have

settled their differences amicably before the Lok Adalat vide award dated

10.01.2018 (Annexure A-1), therefore they are under instructions not to press

the main appeal.

Dismissed as not pressed, as prayed for.

However, it is made clear that parties shall remain bound by the

terms of the settlement as recorded in the award dated 10.01.2018 (Annexure

A-1) rendered by the Lok Adalat.

Impugned judgment and decree of learned First Appellate Court

shall also stands modified to that extent.

Since the matter has been amicably settled before the Lok Adalat,

Registry to refund the Court fee in accordance with law upon an application

being filed by the appellant before the Registry.

Pending applications, if any, shall also stand disposed of.
