In case FIR No.233, dated 09.06.2016, registered at Police
Station Civil Line, Kaithal, District Kaithal, under Sections 21 and 29 of
Narcotic Drugs and Psychotropic Substances Act, 1985 (hereinafter
referred as 'the Act'), respondent-accused have been acquitted of the
charge under Sections 21 and 29 of the Act, vide judgment dated
22.02.2018 by learned Additional Sessions Judge/Special Judge, Kaithal
in NDPS case No.23 of 2016.
Against the aforesaid judgment of acquittal, State has filed
the application under Section 378(3) Cr.P.C. for grant of leave to appeal
along with application for condonation of delay of 212 days in filing the
same.
I have considered the reasons mentioned in the application to
condone the delay and find no merit therein. Application for condonation
of delay of 212 days in filing the application for grant of leave to appeal,
is dismissed and consequent thereto, application for grant of leave to
appeal is also dismissed being barred by limitation.
Dismissed.
