Learned counsel for the revision petitioners states that the suit for

specific performance of agreement to sell filed by plaintiff Shelle Ram against

defendants Karan Singh and others, who are revision petitioners before this

Court has since been dismissed by the trial Court on 18.10.2022, however, the

appeal filed by the plaintiff against the judgment and decree passed by the trial

Court is pending before Additional District Judge, Rohtak. According to

learned counsel for the revision petitioners the revision petition has become

infructuous and he be permitted to withdraw the same granting him liberty to

raise all the pleas before the First Appellate Court.

In view of such statement made by learned counsel for the

revision petitioners, the revision petition is dismissed as withdrawn with liberty

aforesaid.
