1. Appeal is against judgment and decree dated 10.03.2016, passed by the learned Addl. District Judge, Mohali, upholding the judgment and decree dated 23.01.2015, passed by the learned Civil Judge (Junior Division), Kharar, decreeing the suit for specific performance filed by the respondent-plaintiff.

2. At the outset, learned counsel for the appellant states that both the appellant as well as the respondent have expired and despite best efforts, legal heirs of the deceased appellant are not coming forward to pursue the instant appeal and that in the circumstances, he has no instructions in the matter.

3. In view of the position noted above, the instant appeal is dismissed for non prosecution.
