RAJ KUMAR 2023.02.10 17:06 IN THE HIGH COURT OF PUNJAB AND HARYANA AT CHANDIGARH 206 Cross Objection No.72-CII of 1986 in/and FAO No.270 of 1986 (O&M) DATE OF DECISION : 8" FEBRUARY, 2023 Kishan Singh .... Appellant Versus Jhandu Ram & others .... Respondents CORAM : HON'BLE MR. JUSTICE RAJBIR SEHRAWAT * OK OK OK Present: None for the appellant. Mr. Aseem Aggarwal, Advocate for the respondents. 3K OK OK 2 RAJBIR SEHRAWAT, J. (Oral)
The present appeal has been filed by the subsequent
purchaser of the offending vehicle, challenging the award dated 03.01.1986 passed by the Motor Accident Claims Tribunal, Ambala (in short, the Tribunal), whereby all the claimants were held entitled to compensation to be paid by the petitioner herein.
As per the office report the respondents have either not been served, or have died. Counsel for the appellant has not made any effort to bring on record the LRs of the deceased respondents or to do the needful for effecting service upon them.
In view of the above, it appears that the appellant has no interest in the present appeal.
Accordingly, the appeal stands dismissed as not pressed.
Since, the main appeal has been dismissed as not pressed, consequently the cross objection filed by the Insurance company is also
disposed of as such.
