Counsel appearing on behalf of the respondent, at the outset,

made statement that the present petition has been rendered infructuous as

the application filed by the petitioner under Order 9 Rule 13 CPC has been

finally decided by the learned trial Court vide its judgment dated 1.9.2023.

2. Counsel appearing on behalf of the petitioner has not disputed

the fact with regard to judgment passed by the learned trial Court on

1.9.2023 whereby its application filed under Order 9 Rule 13 CPC stands

dismissed. However, the counsel for the petitioner made request that the

appeal against the said order/judgment dated 1.9.2023 is already filed

wherein the first appellate Court has also granted stay vide its order dated

6.10.2023.

3. Counsel for the petitioner further submits that at this stage,

only indulgence the petitioner seeks from this Court is that the stay

application, if any, filed by the petitioner before the first appellate court be

disposed of by the said Court in a time bound manner.

4. In view of above, the present petition is hereby disposed of

having been rendered infructuous. However, direction is given to the first

appellate Court to decide the stay application of the petitioner within a

period of 4 weeks of the next date fixed in the said appeal as both the parties

are now aware of the pendency of the said appeal before the first appellate

Court.
