1. The jurisdiction of this Court under Articles 226/227 of the

Constitution of India has been invoked for issuance of a writ in the

nature of Certiorari to quash the action of respondent No.2 for fixation

of less pension in PPO No. HR/KNL/44490 issued on 10.04.2020

(Annexure P-1) with further prayer for issuance of a writ in the nature of

Mandamus to direct the respondent No.2 to re-fix the pension of

petitioner taking into account average of full salary for 12 months

preceding to date of retirement in accordance with provisions of the

Employees Provident Fund Pension Scheme, 1995 and at par with

similarly situated retirees from the Head office and to release the arrears

of pension with 18% interest per annum from the date it became due till

its actual realization.

2. Learned counsel for the parties are ad idem that the issue

involved in the present case is squarely covered by the judgment

rendered by a co-ordinate Bench of this Court in the case of "Shree

Krishan Sharma and others vs. Employees Provident Fund

Organization and others", CWP No.20224 of 2021, decided on

18.10.2022, accordingly, the instant petition be also disposed of in the

same terms.

3. In view of above, the present petition is disposed of in terms

of Shree Krishan Sharma's case (supra).

4. All pending application(s), if any, shall also stand closed.
