By way of present appeal, challenge has been laid to

judgments and decrees dated 18.03.2014 and 24.11.2017 passed by

the Courts below whereby suit for permanent injunction filed at the

instance of appellants-plaintiffs stands dismissed..

2. Learned counsel for the appellants submits that during

pendency of present litigation, the parties who happened to be co-

sharer have already got the suit land partitioned thereby rendering the

cause of action in the suit as infructuous.

3. In view of the aforesaid development, learned counsel for

the appellants does not intend to press this present appeal.

4. Disposed of being not pressed.
