Present writ petition has been filed for issuance of a writ in the

nature of certiorari for quashing the illegal order dated 17.05.2019

(Annexure P-2) passed by learned Assistant Collector, 2nd Grade, Maham,

District Rohtak vide which the petitioner was proceeded as ex-parte; order

dated 26.08.2022 passed by learned Assistant Collector, 2nd Grade, Maham

vide which naksha bay was accepted and order dated 11.01.2023 passed by

Assistant Collector, 2nd Grade, Maham, vide which Sanad Taksim was

issued without considering the facts of the present case and without

considering the equity in favour of the parties, wrongly and illegally. Fur-

ther prayer has been made to direct the respondents not to change the na-

ture of property and during the pendency of present petition, the possession

of petitioner be protected.

Learned counsel for the petitioner has submitted before this

Court that the partition proceedings were initiated after the amendment

dated 10.04.2017 and in view of the judgment passed by a Coordinate

Bench of this Court in CWP No.20012 of 2022, "Ishwar Singh and

others vs. State of Haryana and others", learned counsel for the petitioner

prays for withdrawal of the present petition with liberty to avail the remedy

as available to petitioner in accordance with law.

Dismissed as withdrawn with liberty aforesaid.
