The prayer in the present petition under Section 482 Cr.P.C.

is for quashing of the Complaint No.COMI/32054/2013 dated

06.02.2013 (Annexure P-3) registerd under Sections 341, 323, 324, 325,

506, 148, 149 IPC at Police Station Bhogpur, the summoning order

dated 03.07.2015 (Annexure P-5) and all subsequent proceedings arising

therefrom.

Ms. Shreya Rana, Advocate has put in appearance on behalf

of respondent No.2 and has filed her Vakalatnama. The same is taken on

record.

The brief facts of the case are that the aforementioned

complaint came to be registered in which some of the co-accused of the

petitioner have been acquitted. The petitioner who was a proclaimed

offender returned back to India and faced trial and has since been

acquitted vide judgment dated 10.07.2023 passed by the JMIC, 1st Class,

Jalandhar. At the stage when the petitioner was returned back to India,

this Court imposed a condition upon him that he would hand over his

passport to the Trial Court which was directed not to return the same to

the petitioner till the conclusion of the trial.

Now, the trial has concluded in the acquittal of the

petitioner and no appeal has been preferred by the State/complainant

against the said judgment of acquittal and the period of limitation has

already expired.

In view of the above, the Trial Court is directed to return the

passport to the petitioner forthwith to enable him to travel abroad.

Disposed of.
