The petitioner seeks grant of regular bail in case FIR No. 0233 dated 30.09.2021, registered at Police Station Model Town, District Hoshiarpur, under Sections 304 and 34 IPC.

Learned counsel for the petitioner submits that the petitioner has been in custody for more than 1 % years. Identically situated co-accused namely Karan @ Karan Kumar has been granted regular bail by this Court vide order dated 15.02.2023 passed in Crl. Misc. No. M-7240 of 2023 (Annexure P-3), thus, the petitioner deserves the same concession.

Custody certificate dated 19.04.2023 digitally signed by Sh. Anurag Kumar, Superintendent of Central Jail, Hoshiarpur has been filed in Court. The same is taken on record. A perusal thereof shows that the petitioner has undergone actual custody of 01 year, 06 months and 20 days and there is no other criminal

case pending against him.

Learned State counsel concedes that the co-accused Karan @ Karan Kumar is identically situated as the petitioner. Thus, the petition is allowed keeping in view the principle of parity. The petitioner is directed to be released on bail on his furnishing bail and surety

bonds to the satisfaction of the trial Court/Duty Magistrate, concerned.
