The present application has been filed for review of the order dated

22.08.2022, whereby the writ petition filed by the applicant-petitioner was

disposed of as having been rendered infructuous as he has been re-instated

in service.

Counsel for the applicant-petitioner has submitted that he was

dismissed from service on 12.12.2016 and was reinstated on 19.12.2019 on

account of his acquittal by this Court and for the intervening period from

12.12.2016 to 19.12.2019 as such, the applicant-petitioner has not been

granted any benefit and, therefore, challenge was made to the impugned

Rules, which issue has not been redressed in the order dated 22.08.2022.

respondent nos.2 and 3.

Keeping in view the fact that the re-instatement was during the

pendency of the writ petition and the said facts were not borne out as such

from the records and neither the said reinstatement was placed on record to

show the terms and conditions of the reinstatement, we are of the

considered opinion that the review of the judgment dated 22.08.2022 is not

liable to be allowed. However, the applicant-petitioner is at liberty to file a

fresh petition on the same cause of action after placing the relevant material

on record.

The present review application is accordingly disposed of in

the aforesaid terms.
