The instant Execution Application has been filed under Order 21 Rule 11 CPC read with Vol.-1, Chapter 12, Part-C of the High Court Rules and Orders for seeking release of the amount of Rs. 51,65,524/- claimed to be due in favour of the petitioner.

Status report by way of affidavit of Vijay Dalal, Executive Engineer, Provincial Division No.2, PWD B &R, Branch Rohtak, respondent No.4 and on behalf of respondent No.1 to 4 has been filed today in Court.

It has been averred that in compliance to the judgment dated 01.02.2022 passed by this Court, the petitioner had claimed the amount of Rs. 52 lacs including the security amount. The actual claim of the petitioner was Rs. 44,46,166/- except the security amount had been remitted in the account of the petitioner on 08.09.2022. The security amount of Rs. 7,78, 508/- has also been remitted in his account on 20.10.2022 and as such the claim of the petitioner has been fully satisfied.

In view of the aforesaid stand, the present Execution Application is ordered to be consigned.

Insofar as the issue pertaining to interest on delayed payment is concerned, the petitioner would at be liberty to claim the same in accordance with law.
