This common order will dispose of all the four connected

petitions, details of which have been given in the heading, as the common

question of law arises in all of them.

In the present petitions, grievance of the petitioners is that they

were working on contract basis with the respondent-Department, prior to

regularization of their services and after the said regularization, they have

not been granted the benefit of the judgment passed by the Division Bench

of this Court, while deciding CWP-2371-2010 titled as "Harbans Lal Vs.

State of Punjab and others", decided on 31.08.2010, according to which,

an employee, who was in service as on 01.01.2006, is entitled for the grant

of pensionary benefits under the old pension scheme.

From the pleadings, it transpires that the same grievance has

also been raised by the petitioners before the respondents by serving legal

notices dated 16.07.2020 (Annexure P-11), 16.07.2020 (Annexure P-10),

16.03.2020 (Annexure P-9) and 16.03.2020 (Annexure P-8A) in CWP-

17371-2020, CWP-7871-2021, CWP-8816-2021 and CWP-10646-2021,

respectively.

At this stage, learned State counsel submits that the appropriate

speaking orders on the said legal notices will be passed by the authorities

concerned within a period of eight weeks from the date of receipt of the

copy of this order and in case, the petitioners are found entitled for the grant

of any benefit, the same will also be released in their favour within a period

of four weeks thereafter.

Keeping in view the above, the present petitions are disposed of

with a direction the respondents to decide the aforesaid legal notices, filed

by the petitioners, by passing the appropriate speaking orders, as undertaken

by learned State counsel, within a period of eight weeks from the date of

receipt of the copy of this order and in case, the petitioners are found

entitled for the grant of any benefit, the same be also released in their favour

within a period of four weeks thereafter.

Photocopy of this order be placed on the files of other

connected cases.
