Learned counsel for the petitioners argues that the question of
law, which is being raised in the present petition, is covered by the judgment
passed by a co-ordinate Bench of this Court in CWP-21636-2021, titled as
"Bikramjeet Ahluwalia and others Vs. Union of India and others",
decided on 27.10.2021, but still the benefit of the said judgment is not being
extended to the petitioners and that too without any valid justification, which
should have been extended to other similarly situated employees by the
respondents keeping in view the settled principle of law laid down by the
Division Bench in its judgment passed in CWP-4382-2002, titled as
"Satbir Singh Vs. State of Haryana", decided on 21.03.2002, according to
which, once a principle of law is settled, the same is to be made applicable
upon every similarly situated employee and the employees should not be
forced to approach the Court time and again to claim the same relief.
Learned counsel for the petitioners further submits that the
petitioners have raised the same grievance before respondent No.2 by

serving legal notices (Annexure P-3 to P-20), which are still pending
consideration with the authorities concerned and the petitioners will be
satisfied at this stage, in case a time bound direction is given to respondent
No.2 to decide the said legal notices, by passing an appropriate speaking
order.
Keeping in view the facts and circumstances of this case and
without going into merits of the claim as raised by the petitioners in the
present case as well as in the legal notices (Annexure P-3- to P-20), this
petition is disposed of with a direction to the respondent No.2 to pass an
appropriate speaking order on the legal notices (Annexure P-3 to P-20), filed
by the petitioner, within a period of eight weeks from the date of receipt of
the copy of this order.
