This petition has been filed praying for quashing of order dated 13.10.2021 (Annexure P-4) passed by learned Additional Sessions Judge, Fatehgarh Sahib whereby petitioner has been directed to deposit 20% of compensation amount awarded by trial Court. He has also assailed order dated 11.1.2022 (Annexure P-6) passed by learned Additional Sessions Judge, Fatehgarh Sahib whereby his application for depositing 20% of compensation amount has been dismissed.

A complaint under Section 138 of Negotiable Instruments Act was filed against petitioner by respondent. Vide judgment and order dated 14.9.2021 (Annexure P-2) of learned Chief Judicial Magistrate, Fatehgarh Sahib, petitioner has been convicted under Section 138 of Negotiable Instruments Act. He was sentenced to undergo rigorous imprisonment for 1 year and to pay compensation of Rs. 25,00,000/- to complainant-respondent. He filed an appeal against said judgment and order, in which impugned orders have been passed.

Learned counsel for petitioner states that he will not press this petition if he is given reasonable time to deposit 20% of compensation amount, in terms of directions contained in impugned order.

In view thereof, this petition is dismissed as not pressed. However, petitioner may deposit 20% of compensation amount, in terms of orders dated 13.10.2021 (Annexure P-4) and 11.1.2022 (Annexure P-6), within 60 days from today i.e. on or before 1.6.2022.
