VINOD S. BHARDWAJ, J(Oral) This case has been taken up through Video Conferencing via Webex facility in the light of Pandemic Covid-19 situation and as per instructions.

The instant petition under Section 482 Cr.P.C., has been filed for quashing of impugned judgment dated 22.01.2020 (Annexure P-8) as well as the order of sentence dated 22.01.2010 (Annexure P-9) passed in criminal complaint No.4948 of 2015 titled as Surinder Bala Vs. Prem Lal and another under Section 138/142 of Negotiable Instruments Act and all consequential proceedings pending before the learned Appellate Court.

The petitioner contends that they have already settled the loan with the concerned bank/Asset Reconstruction Market Company (India) Ltd. and that they are repaying the amount outstanding/due against him in terms of the settlement.

After arguing for sometime, learned counsel for the petitioners seeks to withdraw the instant petition with liberty to move an appropriate application under the Negotiable Instruments Act pointing out the settlement against the parties before the Appellate Court.

Dismissed as withdrawn with liberty as aforesaid.
