The present petition has been filed on the ground that the

petitioner is entitled for the revision of pension keeping in view the

judgment of this Court in CWP No.7239 of 2015 titled as 'Labh Singh

Dhaliwal and others vs. State of Punjab', decided on 18.12.2019 (Annexure

P-2).

Learned counsel for the petitioner submits that though the

petitioner has earlier filed representation with the respondents but, his

pension is not being revised and that too without any valid justification.

Learned counsel for the petitioner further submits that at this stage the

petitioner would be satisfied in case a direction is given to the respondents

to decide the legal notice dated 22.2.2022 (Annexure P-5) in a time bound

manner as the grievance, which has been raised in the present petition, has

also been raised in the said legal notice.

Notice of motion.

Mr. Navdeep Chhabra, DAG, Punjab accepts notice on behalf

of respondents and raises no objection in deciding the legal notice dated

22.2.2022 (Annexure P-5) in a time bound manner.

Without going into the merits of the case or binding upon the

claim being made by the petitioner in the present petition or in the legal

notice, the respondent No.2 is directed to decide the legal notice dated

22.2.2022 (Annexure P-5) within a period of eight weeks from the date of

receipt of certified copy of this order. In case, after the decision, the

petitioner is found entitled for any benefits, the same be also extended to

him within a period of next four weeks thereafter.
