Present petition has been filed under Section 482 Cr.P.C. for quashing the order dated 03.12.2021 of learned Additional Sessions Judge, Patiala, whereby the joint application of the petitioner and the complainant to compound/compromise the matter has been dismissed.
Vide judgment and order dated 08.01.2018 of learned Judicial Magistrate First Class, Patiala, the petitioner has been convicted under Sections 279, 304-A and 427 IPC and sentenced to undergo imprisonment for two years. He has filed an appeal there against which is pending before the learned Sessions Judge, Patiala During the pendency of the appeal, the petitioner and the complainant moved the application for compounding the offence. The application has been dismissed on the ground that the offences under Sections 279, 304-A IPC are not compoundable.
There is no error or infirmity in the order. Accordingly, the present petition is dismissed.
