By this petition, the petitioner seeks the concession of
anticipatory bail, upon FIR no.78, dated 27.9.2020, having been registered
at Police Station Bholath, District Kapurthala, alleging therein the
commission of offences punishable under Section 379-B/34 of the IPC.
Learned counsel appearing for the petitioner very fairly
submits that in terms of the judgment of the Supreme Court in Manish Jain
versus the Haryana State Pollution Control Board, [SLP (Crl.) no.5385 of
2020], dated 20.11.2020, this petition would not be maintainable and
consequently he may be allowed to withdraw it with liberty to surrender
before the competent court to file a petition under Section 439 of the Cr.P.C.
in terms of the aforesaid judgment of the Supreme Court.
Dismissed as withdrawn with the aforesaid liberty.
