By filing this petition under Section 482 Cr.P.C., the petitioner

has challenged the order dated 20.09.2021 passed by Ld. Additional

Sessions Judge, Amritsar, whereby, the interim bail granted to the petitioner

vide order dated 08.04.2020 has been cancelled and he has been ordered to

be summoned through arrest warrants.

Vide judgment and order dated 09.03.2020 passed by Judicial

Magistrate Ist Class, Amritsar, the petitioner was convicted under Section

138 of the Negotiable Instruments Act and sentenced to undergo rigorous

imprisonment for one year and also to pay compensation of Rs.3,00,000/- to

the complainant. He filed appeal, wherein, vide order dated 08.04.2020

passed by Ld. Additional Sessions Judge (Duty), Amritsar, the sentence of

imprisonment was ordered to be suspended on furnishing bail/surety bonds

to the satisfaction of the Trial Court. It was also directed that in view of the

amendment of Negotiable Instruments Act vide Negotiable Instruments

(Amendment) Act, 2018, that the petitioner shall deposit an amount equal to 1 of 2

CRM-M-6484-2022(O&M) [2]

20% of the amount of compensation before the concerned Court within a

period of 60 days.

The petitioner failed to deposit the requisite statutory amount

i.e. 20% of the compensation. On 03.09.2021, he requested for granting one

more opportunity to comply with the order dated 08.04.2020, which was

granted. Then again on 20.09.2021, instead of depositing the amount as

directed, the petitioner absented from the Court. In was in these

circumstances that the Ld. Appellate Court passed the impugned order.

There is no ground to interfere.

Petition dismissed.
