This is an application seeking condonation of delay of 399 days in filing the appeal.

For the reasons stated in the application, the same is allowed and delay stands condoned.

Main case All the counsels are ad idem that the present appeal is to be re- heard by the Appellate Authority in view of the judgment rendered in CR No.94 of 2019 decided on 20.11.2019 titled as "M/s Metro Valley Business Park Pvt. Ltd. Vs. Municipal Corporation, Gurugram and others."

Accordingly, the appeal is disposed of in terms of the judgment ibid and matter is remanded back to the appellate authority to be re-heard.

Pending applications, if any, shall also stand disposed of.
