It is submitted that pendency of an FIR is no ground to refuse re-
issuance of passport. Thus, a direction be issued to the passport authorities to
decide the case of the petitioner by keeping in view the law laid down in Sahib
Jaskaran Singh vs. Union of India and others, 2016, (2) RCR (Criminal) 798.
Notice of motion.
Mr. Ankur Sharma, Advocate for Mr. Arihant Goyal, Advocate
accepts notice on behalf of respondents No.1 & 2 and waives service.
Mr. Arun K. Kaundal, DAG, Punjab, accepts notice on behalf of
respondent No.3 and waives service.
Considering the nature of the order being passed, no reply is
necessary.
The petition is disposed of with a direction to respondent No.2 to
decide the case of the petitioner by passing a speaking order keeping in view the
judgment passed in Sahib Jaskaran Singh (supra) within eight weeks from the
date of receipt of a certified copy of this order .
