Learned counsel for the petitioner(s) submits that claim of the
petitioners is covered by the judgement of the Division Bench of this Court
in CWP-19641-2009 titled as R.K. Aggarwal vs. State of Haryana
decided on 21.12.2012, which benefit is not being extended to the
petitioners without any valid justification, even though, the said judgment
has already attained finality upto the Hon'ble Supreme Court of India.
Learned counsel for the respondents submits that the claim of
the petitioners will be considered as per the judgment in R.K. Aggarwal
case's (Supra) and an appropriate order will be passed by the respondents
and in case after the decision, it is found that the petitioners are entitled for
any benefit, keeping in view the judgment in R.K. Aggarwal case's
(Supra), the same will be extended to the petitioners within a period of 08
weeks from the date of receipt of copy of this order.
Learned counsel for the petitioners submits that keeping in
view the statement of the learned State counsel, the present petition may
kindly be disposed off having been not pressed any further.
Ordered accordingly.
A photocopy of this order be placed on the files of connected
cases.
