This petition under Section 438 Cr.P.C. is filed seeking anticipatory bail in FIR No. 133 dated 11.6.2022, under Sections 21 and 29 of the Narcotic Drugs & Psychotropic Substances Act, 1985 registered at Police Station Sanoli, District Panipat.
Learned counsel for the petitioner, after arguing for some time and realising that in view of the judgment of the Supreme Court in State of Haryana Vs. Samarth Kumar, Criminal Appeal No. 1005 of 2022, decided on 20.7.2022, his contentions are not finding favour, does not press the present petition. However, a request is made that the petitioner would surrender within ten days from today and apply for regular bail, his application be taken up expeditiously.
The petition is disposed of.
In case the petitioner surrenders within ten days from today and applies for regular bail, the court concerned shall take up the bail application within two days and decide it as expeditiously as possible.
