Learned counsel for the appellant, in the light of the judgment

of the Hon'ble Supreme Court in the case of M/s ICOMM Tele Ltd. vs.

Punjab State Water Supply & Sewerage Board and another, 2019 (5) R.C.R.

(Civil) 242, contends that the appeal has been rendered infructuous. He

further states that the appellant has already filed an application under

Section 11 of the Arbitration and Conciliation Act, 1996, which he would

pursue before the competent Court.

In the light of the above, the present appeal is disposed of as

infructuous with liberty, as prayed for, in accordance with law.
