An application filed by the Judgment Debtor to stay the
execution proceedings on account of the pendency of the regular second
appeal, has been dismissed.
The petitioner claims to be a 3rd party objector. The
proceedings in the execution petition cannot be kept in abeyance only
because the Regular Second Appeal is pending, in view of Order 41 Rule
5(1) of the Civil Procedure Code.
Hence, no ground to interfere is made out.
Dismissed.
All the pending miscellaneous applications, if any, are also
disposed of.
