This petition under Section 482 Cr.P.C has been filed for
quashing of judgment dated 22.09.2017 passed by Additional Sessions
Judge, Panipat in Criminal Revision No.85 of 2017 whereby order dated
12.05.2015 passed by Judicial Magistrate Ist Class, Panipat, summoning of
respondents No.2 and 3 was set aside.
Learned State counsel, at the very outset, contends that the
controversy involved in the present case is squarely covered by the
judgment passed by this Court in Sukhpal Singh Khaira v. The State of
Punjab; Criminal Appeal No.885 of 2019; dated 05.12.2022 and the instant
petition has rendered infructuous.
This contention of the learned State counsel is not controverted
by the learned counsel for the petitioner.
Disposed of has having been rendered infructuous.
